Welcome to ZeeZest (the "Service"). The Service includes the ZeeZest website i.e. https://zeezest.com/ and all on-demand and live content services available through the ZeeZest website, including all features and functionalities, recommendations, reviews and user interfaces. The Service is operated and provided to you by Zee Entertainment Enterprises Ltd, a company incorporated under the provisions of the Companies Act, 1956, having Corporate Identity Number L92132MH1982PLC028767 and having its registered office at Marathon Futurex, A-Wing, 18th Floor, N.M. Joshi Marg, Mumbai – 400 013 (“ZEEL”), "we", "us" or "our". By accessing, installing or using the Service, you confirm that you are 18 years old or over. This document is an electronic record in accordance with the Information Technology Act, 2000 and rules there under as applicable. This electronic record is generated by a computer system and does not require any physical or electronic/digital signatures. Please read these terms (the "Terms of Use") before accessing or using the Service. Terms of Use set out the agreement for your access to and use of the Service. By accessing or using the Service you agree to these Terms of Use. If you don't agree to them, please don't use the Service and any such use of the Service thereafter shall be deemed un-authorized.
1. Access to the Service
1.1 By accessing or using the Service, you will be able to access and view content, which may include videos, music, graphics, text, blogs, informative articles, images and photographs ("ZeeZest Content"), in accordance with the terms and conditions set out in these Terms of Use.
1.2 You may be able to access and view some ZeeZest Content for free, but some functionality and / or ZeeZest Content may only be available to you if you register a ZeeZest account ("ZeeZest Account").
1.3 In order to access certain ZeeZest Content, we may require you to register a ZeeZest Account by providing your details or by using an account you already hold with a third-party platform or other partner.
1.4 The Service is available for individuals who have attained the age of majority in their jurisdiction. In the case of India, this service is restricted to users who are aged 18 years or older. You must be aged 18 years or older to access the Service, register a ZeeZest Account. If you are under 18 years of age, you may access the Service via your parent’s/guardian’s account and under the supervision of an adult and in accordance with applicable law which enables a minor to access such a service.
2. Your data usage
2.1 You are responsible for all internet access, mobile data or other charges incurred when using the Service. Remember that streaming and downloading audio-visual content such as videos and games can use up a lot of data.
3. Changes to the Service
We may regularly make changes to any element of the Service, your ZeeZest Account or the ZeeZest Content. In particular, the availability of ZeeZest Content may change from time to time (for various reasons, such as where relevant third-party rights-holders withdraw or restrict our right to use that content on the Service). We therefore have the right to add or withdraw ZeeZest Content at any time, with or without notice. You acknowledge and agree that the ZeeZest Content is variable and will change from time to time without notice. There may also be times when we have to remove certain features or functionality and/or stop allowing certain devices or platforms from being able to access the Service. We may also update or upgrade the Service from time to time.
4. Ownership
4.1 The Service and all ZeeZest Content is protected by copyright, trademark, and/or other proprietary intellectual property rights owned by or licensed to us.
4.2 No intellectual property rights in, or to, the Service, ZeeZest Content or the ZeeZest brand or logos, is deemed to be granted to you via your access or use of the Service, unless specifically granted to you in accordance with these Terms of Use.
4.3 You may not remove, alter or in any way tamper with any copyright notices or other proprietary markings included in the Service or any ZeeZest Content. Any copying, access, transfer, public performance or communication to the public, non-private viewership or other use of the Service, the ZeeZest Content shall constitute an infringement of applicable intellectual property rights and a breach of these Terms of Use. In the event of such infringement, we, or one of our affiliated companies, may, without notice or prior intervention of a court or arbitral body, block your access to the Service and terminate any ZeeZest Account you may have and pursue any rights or remedies available to us.
5. Your use of the Service
5.1 You represent and warrant that: (a) any information and details provided by you to us, including on registration of a ZeeZest Account, are true, accurate and up to date in all respects and at all times; (b) you will at all times comply with these Terms of Use and other policies of ZEEL that may be published on the platform from time to time; and (c) you will not use the Service for any unlawful purpose or in a way which infringes the rights of anyone else.
5.2 You must use the Service in accordance with all applicable laws, rules and regulations, and any other restrictions on your use of the Service or the ZeeZest Content.
5.3 You must not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Service or ZeeZest Content.
5.4 The Service and ZeeZest Content are licensed to you (not sold) for your personal and non-commercial use only. While you are using the Service, we grant you a limited, revocable, non-exclusive, non-transferable, license to access the ZeeZest Content and stream, download, temporarily store and view the ZeeZest Content. Except for the limited license granted to you in these Terms of Use, no right, title or interest in the Service or the ZeeZest Content shall be transferred to you. You must not reproduce, perform, display or exhibit the Service or the ZeeZest Content in any public place or in any manner not expressly permitted under these Terms of Use.
5.5 You must not, and must not allow third parties to: (a) access, view and/or purchase the ZeeZest Content using a virtual proxy network; (b) display, perform, publish, license, offer for sale, make, re-transmit and/or distribute copies of the Service or ZeeZest Content; (c) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Service or the ZeeZest Content except as permitted by applicable law; (d) create derivative works of the Service, or the ZeeZest Content of any kind whatsoever; (e) use or launch any automated system, including without limitation, “robots”, “spiders”, “offline readers”, “bots” or the like that access the Website in a manner that sends more requests or messages to the Service in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser; or (f) circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Service or the ZeeZest Content. Furthermore, you must not allow third parties to use your login credentials to access your ZeeZest Content.
5.6 The Services may contain links to third party websites, products or services ("Third Party Services"). You acknowledge that: (a) we are not responsible for any of the Third Party Services or for any losses or harm you may suffer due to the Third Party Services; (b) you are responsible for any costs that you incur in relation to the Third Party Services; and (c) your interaction with that third party may be governed by a separate set of terms and conditions and privacy policy.
5.7 In case of any breach by you of these Terms of Use, we reserve the right to initiate legal action against you to recover any losses, damage, liabilities, costs or expenses that we may suffer or incur as a result of your breach of these Terms of Use and to enforce any right or remedy that we have at law.
6. Privacy
61. Any personal information you supply to us or that we collect from you when using the Service or will be used by us in the ways set out in our Privacy Policy.
62. You acknowledge, consent and agree that we may access, preserve, transfer and disclose your account information and personal information subject to the Privacy Policy, if required to do so by law to: (a) comply with legal process and/or any applicable law; (b) enforce these Terms of Use; (c) respond to your requests for customer service; or (d) protect the rights, property or personal safety of ZeeZest/ZEEL, its affiliates, users and the public.
7. Our liability to you
7.1 If we breach these Terms of Use, we will only be liable for losses which are a reasonably foreseeable consequence of that breach. Losses are foreseeable where they could be contemplated by you and us at the time of you agreeing to these Terms of Use. Neither we nor our directors, officer, employees, affiliates or licensors will be liable for any indirect, remote, incidental, punitive or special damages arising from your use of the Services or any content or material thereof or for any other claim related in any way to your use of the Service or any content or material thereof, or any loss or damage of any kind incurred as a result of the use of the Services or any content or material thereof, even if advised of their possibility. You waive all special, indirect and consequential damages against us.
7.2 We are not responsible for: (a) any use of the Service or ZeeZest Content which isn’t authorised by us; (b) any malfunction or interruption to the Service or ZeeZest Content due to unforeseeable circumstances that prevent us from fulfilling our obligations to you;(c) errors, viruses or bugs present in or arising from your use of the Service or ZeeZest Content;(d) incompatibility of the Service or ZeeZest Content with any other software or hardware (including any of your devices); and(e) any act or default of any third party supplier, device manufacturer or provider of a device operating system, which are beyond our reasonable control.
7.3 You have certain statutory rights under the applicable laws of India. Nothing in these Terms of Use is intended to affect these statutory rights.
7.4 The use of website is at your sole risk. User specifically acknowledges and agrees that ZEE ENTERTAINMENT ENTERPRISES LIMITED shall not be liable for any conduct of any user. The material offered on the website is intended to be strictly informational and is provided on an “as-is” basis.
7.5 We can't guarantee that the Service or the ZeeZest Content will be free from bugs or errors or that your access will be free from interruptions (for example there may be downtime for maintenance or updates or any power or server outages or other reasons outside our control), however where we are made aware of technical issues then we will always try to fix them. We reserve the right to withdraw or modify the Service at any time (and without notice) for repair, maintenance, updating or any other reason. We may restrict access to all or part of the Service to users who have registered with us. We do not accept liability if the whole or any part of the Service is unavailable or inaccessible at any time or for any period.
7.6 Please note that we are not responsible for any lack of functionality or failure to provide any part of the Service or the ZeeZest Content, or any loss of content or data that is due to: your equipment, devices, operating system or internet connection, your failure to download the most recent published version of the Service or meet the compatibility requirements or the consequences of you changing your equipment, device, operating system or internet connection.
7.7 You agree that we shall be under no liability whatsoever to you in the event of non-availability of the Service or any portion thereof occasioned by an ‘Act of God’ which may include, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster, satellite failure or any other cause whatsoever beyond the control of ZEEL.
7.8 We disclaim any liability arising out of advertisements or third-party material or content that may be displayed on the Service, as well as your viewing or usage of such products or services advertised via the Service. Any dealings you have with advertisers or third parties found while using the Service are between you and the advertiser / third party, and you agree that we are not liable for any loss or claim that you may have against an advertiser / third party.
8. Changes to these Terms of Use
8.1 We may, from time to time, change these Terms of Use.
8.2 Whenever reasonably applicable, we will aim to notify you at least 30 days before making any material changes to these Terms of Use, unless the changes need to be implemented quickly for security, legal or regulatory reasons in which case we will notify you of the changes as soon as we can.
8.3 You are requested to visit the website time to time to access and stay updated with the latest polices as applicable.
8.4 If you continue to use the Service following any change to these Terms of Use, we will take this as your acceptance of the amended Terms of Use. The most up to date Terms of Use will always be available on the Service.
9. Transfer/ assignment of rights
The agreement between us and you is personal to you and no third party is entitled to benefit under it. You agree we can transfer/ assign our rights and obligations under these Terms of Use to any company, firm or person subject to your usage of the Service not being materially adversely affected. You agree to cooperate with us in connection with such an assignment or transfer. You may not transfer/ assign your rights or obligations under these Terms of Use to anyone else.
10. Severance
If any provision of these Terms of Use is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms of Use shall not be affected.
11. Waiver
To the extent we fail to or decide not to exercise any right of claim against you to which we are entitled, this will not constitute a waiver of that right unless otherwise indicated to you in writing.
12. Governing law and Jurisdiction
12.1 These Terms of Use shall be governed by and construed in accordance with the laws of India. However, these terms will not limit any of your consumer protection rights or warranty claims which may not be waived by a contract under the laws of your country of residence.
12.2 You agree that (i) ZeeZest has the right to bring any proceedings before any court of competent jurisdiction and you irrevocably submit to the jurisdiction of such courts; and (ii) any proceeding brought by you shall be exclusively before the courts at Mumbai, India.

14. Communications
We will send you information relating to your account (e.g. confirmation messages, content and feature updates and other service or transactional messages) or marketing communications by in-Service message, SMS or email to the mobile phone number or email address provided during sign up (if you signed up via a third party, for example via one of our partners or using your account details with a platform, then we may obtain your email from that third party or platform so that we can keep you up to date with service-related messages). Through your use of the Service and acceptance of these Terms of Use, you consent to receiving such communications via the modes and media described above.
15. Disclaimer on Warranties
The Service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. Without limiting the foregoing, we do not make any warranties of fitness for a particular purpose, title, merchantability, completeness, availability, security, compatibility or non-infringement; or that the Service will be uninterrupted, free of viruses, malware or other harmful components, accurate, error free or reliable.
16. INDEMNITY
You agree to indemnify, defend and hold harmless ZEEL (including its affiliates), and their officers, directors, employees, agents, licensors and suppliers, from and against any and all claims, liabilities, losses, expenses, damages and costs (including reasonable attorneys’ fees) resulting from any violation of this Terms of Use or applicable law or any activity related to your ZeeZest Account (including negligent or wrongful conduct) by you or any other person accessing the Service using your ZeeZest Account.
17. General Provisions
17.1 Entire Agreement: These Terms of Use constitute an entire, valid and binding agreement between you and ZeeZest and govern your access and use of the Service.
17.2 Advertisements: ZeeZest shall have the right to place advertisements and publicity materials of its choice, including that pertaining to parties other than itself for commercial use through electronic means on the Service.
